New H&S system for construction sites starts 1st October

The government’s new points-based licence H&S system aimed at improving workplace health and safety will come into effect on construction sites from 1st October.

Under this H&S system, construction firms will be issued a licence by the National Labour Inspectorate. First, they have to register with the chamber of commerce and meet specific requirements. These include fulfilling training obligations, possessing a valid social security compliance certificate (DURC), a risk assessment document, and a tax compliance certificate.

The new system, announced in March, will operate similarly to a “driving licence” credit system. It applies to construction companies and self-employed workers. It aims to reduce workplace accidents by enforcing stricter health and safety standards. Initially, managers and employees will be required to prove they have completed proper health and safety training and risk assessments in order to obtain the licence.

Holders will begin with 30 points, with a minimum of 15 points required to continue operations. Points will be deducted for violations. Penalties range from five points for minor infractions to 20 points for activities that result in a worker’s death. If an accident leads to total or partial permanent incapacity, a 15-point deduction will be applied. Accidents causing death or permanent disability could result in the suspension of the licence for up to 12 months.

The H&S system is part of the government’s effort to tighten compliance with occupational health and safety laws at construction sites and reduce the number of workplace injuries and fatalities. The National Labour Inspectorate is set to publish an explanatory circular on Monday, outlining further details of the initiative.
